Firearms Policy Coalition (FPC) Filed New Lawsuit Challenging Arbitrary Regulation

The Firearms Policy Coalition (FPC) has filed a new lawsuit challenging the ATF’s regulation that would establish new terms and a series of regulations for the ATF to enforce. F. Riehl of AmmoLand noted that these regulations include “ones that would treat non-frames and non-receivers as if they were actual frames and receivers of weapons.”

The complaint in this case, VanDerStok v. Garland can be viewed at FPCLegal.org.

“The Final Rule defies the plain language of the [Gun Control Act] and longstanding agency interpretation suggesting that the items at issue here, sometimes colloquially referred to as receiver blanks, unfinished frames or receivers, or 80% frames or receivers, are not firearms,” the complaint read. “Through this rulemaking, however, the Agencies are attempting to create a broad, sweeping definition by including items that are not yet the ‘frames or receivers’ of such weapons and by including ‘frame or receiver kits.’”

“Neither the president nor any federal agency has the power to make law,” stated FPC’s Senior Attorney for Constitutional Litigation Cody J. Wisniewski. “The Constitution is clear–Congress has the power to make law, and the Executive Branch is limited to enforcing that law.”

In effect, the Biden regime wants to bypass Congress and have the ATF and DOJ implement new regulations that exceed the current laws Congress has already established. In effect, the ATF’s powers would be greatly augmented. 

“FPC will not stand idly by while the federal government tramples the rights of peaceable individuals through agency rulemaking,” the pro-gun advocacy organization concluded. FPC is one pro-gun organization that can always be trusted to defend gun owners’ interests. They do the Lord’s works in confronting anti-gun politicians and bureaucrats.

In light of the FBI’s raid of President Donald Trump’s residence in Mar-a-Lago and the clear role the DOJ played in facilitating this police action, gun owners must continue pushing the envelope against the ATF. This agency is unconstitutional and illegitimate. It should be treated as such. 

There should be no more talk about “reforming” the ATF and similar agencies that carry out Gun Con Inc’s agenda. It’s time to start nullifying ATF regulations, defunding it, and ultimately abolish it.

We can no longer afford to have this institution continue to exist on a normal basis. The ATF’s life must be made to be as uncomfortable as possible.
