The ATF was Caught Illegally Copying Firearms Dealer Info

Towards the end of the last month, a viral video of the ATF made the rounds across social media. This video showed an ATF Industry Operations Investigator (IOI) snapping photos of a firearms dealer’s records with her cell phone.
 
According to Jon Crump of AmmoLand News, this video was filmed at Black Metal Firearms, LLC, in Mesa, Arizona. Black Metal Firearms is a federal firearms licensed (FFL) dealer and manufacturer that has built its reputation for its AR-15 rifles. 
 
Per Crump, the issue that this case dealt with “was a disagreement on how a variance for the AR-15 receivers used to build the rifles was entered into the Acquisitions and Disposition (A&D) logbook.”
 
When AmmoLand News reviewed the internal IOI handbook that it obtained back in May from a source at the ATF, they reached the conclusion that the IOI is wrong about the alleged violation. 
 
 Per the ATF’s rule as explained in documents that AmmoLand New was able to acquire from Gun Owners of America (GOA) via a Freedom of Information Act (FOIA) request, IOIs can only photocopy ATF 4473 or other documents to record violations. Those copies have to be treated as “evidence.” 
 
Per the ATF’s rules, copying 4473 forms or any other documents en masse is prohibited. In the video, the ATF employee is seen photographing the whole A&D logbook as opposed to the relative sections. Additionally, the FFL must voluntarily surrender its documents.  
 
 In AmmoLand News’ view, Black Metal Firearms did not consent to having their records copied based on the evidence AmmoLand News was able to acquire. The unidentified IOI who is shown in the video looks like she is violating the ATF’s rules.
The ATF internal document reads as follows:

Execute ATF F 3400.23, Receipt for Property and Other Items, and fully describe the documents. ATF F 3400.23 is to be placed in the licensed dealer’s files in the sequential order of the ATF F 4473 that is being removed. Photocopies of the ATF F 4473 are to be forwarded to the dealer. These copies are to be designated as such and dated and initialed by the case agent.

On July 25, 2022, Black Metal Firearms posted the following on their Instagram page:

“No registry? Here’s our ATF auditor copying every single page of our A&D books with her cell phone camera using an app that reads text. This data includes make, model, serial number, buyer’s name and address, and even the seller. We have well over 20 minutes of footage of this happening in our shop in public view. Yes, this is illegal.”

Under the Biden regime, the rate of FFL revocations has surged over 500% following President Joe Biden’s decision to roll out zero-tolerance policies on gun dealers. Crump observed that “Many of the revocations stem from minor clerical errors by the gun stores.” In addition, Crump noted that “Also, the ATF has been reopening settled cases to revoke FFLs retroactively.” 

The Biden regime claims to be cracking down on “rogue dealers.” However, as Crump noted “most of the shops caught up in the dragnet are small mom and pop stores.”

What we see here with the ATF is to be expected. The ATF is a lifeless bureaucratic agency that is not accountable to the voters. Because of its bureaucratic nature, the ATF can throw its weight around and harass gun owners as it pleases. 

Gun Control Inc. knows that it can’t pass anti-gun measures through legislative means so it has to rely on the ATF to move its agenda forward. With the 2022 midterms right around the corner, grassroots gun activists must pressure Republicans who claim to be pro-Second Amendment to go public with regards to the ATF. Namely, offer up a proposal to limit its power, through defunding or eventually eliminating it. 

The ATF’s continued existence is a threat to our God-given rights and we’re going to need serious leadership from elected officials to address this problem. The ATF won’t abolish itself. As long as the ATF exists, power-hungry individuals who have an ax to grind will have a reliable vehicle to undermine the right to bear arms. 

If there is one agency that needs to be flushed down the toilet, it’s the ATF.
